If You do not understand or have questions about the Privacy Notice or the SHIFTit Terms of Use, immediately stop all use of the Website and/or Services. If You do not agree with this Privacy Policy, please do not use the SHIFTit Website, schedule any services through the SHIFTit Website, or otherwise interact with the SHIFTit Website. By using the SHIFTit Website and/or any services scheduled through the SHIFTit Website, You consent to this Privacy Policy. All references to capitalized terms not defined herein are to have the same meaning as those terms defined in the SHIFTit Terms of Use. This Privacy Policy, effective as of the above-stated Revision Date ("Effective Date"), explains how SHIFTit Corp., a Wyoming corporation (hereinafter, "SHIFTit"), collects and uses information when you, the end-user (hereinafter, "You" or "Your"), visit the SHIFTit Website and any other subpages or applications on the SHIFTit Website domain (which SHIFTit may create, remove, or modify at its sole discretion) or when You schedule any Medical Services through the SHIFTit Website.
Types of Personally Identifiable Information Collected
Personally identifiable information is information that can be used to identify, locate, or contact You ("Personal Information"). It also includes other information that may be associated with Personal Information. SHIFTit collects information from You when You visit and/or schedule services through the SHIFTit Website. The following information may be collected by SHIFTit from You: - Registration information when You schedule services through the SHIFTit Website or enter a SHIFTit promotion, such as Your first name, last name, email address, and phone number; - Transaction information provided by You when requesting services; - Phone calls between SHIFTit and You, and any information contained therein; - Information You provided on SHIFTit documents and forms; - Location information, including location information provided by a laptop computer, tablet, mobile smartphone, or other similar such device interacting with the SHIFTit Website, or associated with Your IP address or other online identifier, where SHIFTit is permitted by law to process such information; - Images, recordings, or any other similar such materials in any medium that may contain Your Personal Information; - Activity information about Your use of the SHIFTit Website, such as content viewed, how often You use the SHIFTit Website, and Your preferences; - Any images uploaded by You, for purposes of associating the image with Your Account "profile picture" or any other similar such type of picture identifying You as the Medical Professional or Healthcare Provider associated with the Account; - Background check information if You sign up to use the Services as a Medical Professional or Healthcare Provider, such as information about Your work history, certifications, and/or educational history (where permitted by law), and such information may be collected by a vendor on SHIFTit's behalf; and - Demographic information about You, including information acquired through user surveys; in some countries, SHIFTit may also receive demographic information about You from third parties.
How Information is Collected
SHIFTit asks for the Personal Information listed above as part of an online registration process to receive services from SHIFTit. SHIFTit also collects information when You request information from SHIFTit, market, provide, or obtain Medical Services from SHIFTit, enter a SHIFTit promotion, or visit the SHIFTit Website. When either SHIFTit or You initiate a call with the other party, SHIFTit may monitor and/or record those calls for quality assurance and customer satisfaction purposes. In those jurisdictions where consent is required for a party to record a telephone call, You consent to SHIFTit recording such calls. SHIFTit may collect Your precise location data through the SHIFTit Website. SHIFTit collects this information to help enable the functionality of the SHIFTit Website, and SHIFTit may also collect the precise location of Your device when You access the SHIFTit Website via that device. SHIFTit may also derive Your location from Your IP address. The SHIFTit Website uses geo-location features to help enable You to search for services that may be obtained through the SHIFTit Website, to improve the SHIFTit Website and/or any services that may be obtained on the SHIFTit Website, and/or for any other reasonable business purpose of SHIFTit, such as a legal purpose, a merger or sale of SHIFTit, or any business-related asset transfers.
Location Data and Mobile Application Permissions
When You use our mobile application, we may request access to Your device's location services. This section explains how we collect, use, and protect Your location data in compliance with applicable app store requirements. Types of Location Data Collected: - Precise Location (GPS): With Your permission, we collect precise location data from Your mobile device to connect healthcare professionals with nearby facilities and shift opportunities. - Approximate Location: We may derive approximate location from Your IP address or network information. - Background Location: Our app may collect location data even when the app is closed or not in use, but only if You have granted background location permission. This enables us to notify You of nearby shift opportunities and facilitate accurate time tracking for shifts. How We Use Location Data: - To display nearby healthcare facilities and available shifts in Your area; - To match healthcare professionals with facilities based on geographic proximity; - To verify attendance and facilitate check-in/check-out for scheduled shifts; - To provide accurate mileage and travel information for reimbursement purposes; - To improve our services and provide location-relevant recommendations. Your Choices and Controls: - You may grant or revoke location permissions at any time through Your device settings. - You may choose to provide only approximate location or disable location services entirely, though this may limit certain features of the app. - Background location collection can be disabled separately from foreground location access. - Disabling location services will not affect Your ability to browse the app, but features requiring location (such as finding nearby shifts) will be unavailable. Data Retention: Location data is retained only as long as necessary to provide the services described above. Historical location data associated with completed shifts may be retained for record-keeping, compliance, and dispute resolution purposes. Third-Party Sharing: We do not sell Your location data to third parties. Location data may be shared with healthcare facilities solely for the purpose of verifying shift attendance and facilitating the services You have requested.
Cookies and Other Technologies
SHIFTit may use cookies and other identification technologies on SHIFTit's Services, the SHIFTit Website, emails, and online ads for the purposes described in this Privacy Policy. Cookies are small text files that are stored on your browser or device by websites, apps, online media, and advertisements. SHIFTit uses cookies and similar technologies for purposes including, but not limited to: - Authenticating Accounts; - Remembering Account preferences and settings; - Determining the popularity of content; - Delivering and measuring the effectiveness of advertising campaigns; and - Analyzing site traffic and trends, and generally understanding the online behaviors and interests of people who interact with the Services. SHIFTit may use "pixel tags" (also called "action pixels," "web beacons," or "clear gifs") and/or JavaScript plug-ins, placed on the SHIFTit Website and in SHIFTit emails to You. These web beacons and plug-ins are small graphic images (typically that you cannot see) or codes on a website or in an email message which are used for such things as recording webpages and advertisements clicked on by a user or for tracking the performance of email marketing campaigns.
How SHIFTit Uses Personal Information
The primary purpose of the Personal Information collected on the SHIFTit Website is to improve, optimize, and further develop the SHIFTit Website. Specifically, Your Personal Information is used to communicate with You about transactions with SHIFTit, to provide personalized content and experiences, to provide additional information that may be of interest to You about the SHIFTit Website, SHIFTit, and/or any of its subsidiaries, affiliates, or partners (such as special offers, promotions, announcements, and information about potential service offerings), and to detect, prevent, and investigate activities which may violate SHIFTit policies, terms, or conditions, or otherwise be fraudulent, illegal, and/or pose safety issues. Opting Out and Updates to Your Personal Information
SHIFTit does not rent, sell, or share Your Personal Information with other parties or non-affiliated companies for their direct marketing purposes without Your express consent. SHIFTit provides You the opportunity to opt out of receiving marketing communications from SHIFTit and its agents, subsidiaries, affiliates, partners, and successors, and assigns and gives You the option to remove Your information from the SHIFTit Website, to not receive future marketing communications, or to no longer receive access to the SHIFTit Website and any services that may be obtained through the SHIFTit Website. You may opt out of the sharing or sale of Your Personal information by contacting SHIFTit Support via email at hello@shiftithealth.com, or by visiting the opt-out page. If You receive an unsolicited marketing communication from the SHIFTit Website, please contact SHIFTit by sending a written request to the address provided in the section of this Privacy Policy entitled "Notice." You may also make requests regarding Your Personal Information, such as requests to access information or requests to update or correct inaccurate information, by sending a written request pursuant to the methods of providing notice to SHIFTit as set forth in the section of this Privacy Policy entitled "Notice."
Security and Retention of Personal Information
SHIFTit follows generally accepted industry standards to store and protect Personal Information, secure servers, databases only accessible by those authorized with special access rights to such systems, and routine monitoring of these systems and data. No method of electronic data transmission or storage is completely secure, and for this reason, there is no guarantee that information will not be accessed, disclosed, altered, lost, or destroyed by breach of any of SHIFTit's physical, technical, or managerial safeguards. SHIFTIT EXPRESSLY DISCLAIMS ANY REPRESENTATION OR WARRANTY, WHETHER EXPRESSED OR IMPLIED, WITH RESPECT TO ENSURING, GUARANTEEING, OR OTHERWISE OFFERING ANY DEFINITIVE PROMISE OF SECURITY IN CONNECTION WITH YOUR PERSONAL INFORMATION, AND FURTHER DISCLAIMS ANY LIABILITY THAT MAY ARISE SHOULD ANY OTHER INDIVIDUALS OBTAIN THE PERSONAL INFORMATION YOU HAVE SUBMITTED TO THE SHIFTIT WEBSITE. SHIFTit keeps Your personal data only as long as necessary to provide You with access to the SHIFTit Website, services obtained through the SHIFTit Website, and other legitimate and essential business purposes.
California Privacy Rights
Pursuant to §1798.83 of the California Civil Code, residents of California can obtain certain information about the types of Personal Information that companies with whom they have an established business relationship have shared with third parties for direct marketing purposes during the preceding calendar year. California Consumer Privacy Act ("CCPA"). Pursuant to §1798.100 of the California Civil Code, residents of California are provided specific legal rights regarding personal information. These rights include: 1) The right to request that a business disclose the specific personal information collected; 2) A business shall inform consumers at or prior to the point of collection as to the categories of personal information not to be collected and for what purposes it will be used; 3) A business will only disclose personal information to a consumer upon receipt of a verifiable consumer request; 4) A business is required to respond to verifiable customer requests to access personal information at least twice in a twelve (12) month period; 5) Information from a one-time transaction that is not sold or retained by the business does not need to be retained by the business.

All notices to You regarding this Privacy Policy will be sent via e-mail to Your email address on file with SHIFTit at the time of the sending of the notice; if SHIFTit does not have Your email address on file, then notice to You will be provided by first-class mail. SHIFTit reserves the right to update this Privacy Policy; any such changes are deemed effective as of the earlier date between the date You receive notice of the changes or thirty (30) days after the date such updated terms are published on the SHIFTit Website.
